GENERAL TERMS AND CONDITIONS - TICKET SALES

The General Terms and Conditions govern the legal relationships between the owner of a purchased ticket on one side and the company MaxiTicket s.r.o., with its registered office at: Drevárska 23, 902 01 Pezinok, Company ID: 53251580, registered in the Commercial Register of the District Court Bratislava I, Section Sro, Insert No. 148442/B (hereinafter referred to as "MaxiTicket") on the other side (hereinafter referred to as "GTC").

1 Definition of Terms

1.1 MaxiTicket is the operator of the graphically-oriented network solution MaxiTicket for ticket sales and management of stadiums, cultural centers, or events in Slovakia and in European countries (hereinafter referred to as "MaxiTicket").

1.2 Based on an agreement with contractual partners (hereinafter referred to as the "Organizer") using the MaxiTicket system to manage their events, MaxiTicket is authorized to provide ticket sales through the MaxiTicket system for these events listed in the MaxiTicket system to end users (visitors), on behalf of and for the account of the Organizer.

1.3 Organizer is a natural or legal person who uses the MaxiTicket system for selling and electronically distributing tickets for their events.

1.4 Event is a public performance, event, concert, or social activity of a cultural or sports nature for which tickets are sold through the MaxiTicket system. Events are organized and held by the Organizer (hereinafter referred to as the "event").

1.5 Ticket is a valuable document and at the same time a certificate allowing its holder a one-time entry to the event for which it was purchased. The ticket is valid only for the event for which it was purchased; it cannot be used for another event or exchanged for a ticket to a different event. Current ticket prices are published on the Organizer’s website.

The ticket includes: the name, date, start time, and venue of the event, a precise description of the seat location if applicable, the ticket price, a barcode or QR code with a unique ticket number, identification of the event Organizer, and a security feature if this is part of the ticket.

1.6 Holder of the ticket is the person who purchased the Ticket via the MaxiTicket system through the website https://www.maxiticket.sk, the Organizer’s website, partner websites, or at the Organizer’s sales location.,

1.7 Types of Tickets

1.7.1 Paper ticket with security features (hereinafter referred to as the "ticket") is a standard ticket issued by the MaxiTicket system and delivered to the ticket holder by courier or post. Shipping and packaging costs are borne by the ticket holder. These costs are included in the total order price after selecting the corresponding option in the delivery method field.

1.7.2 ticket@home is an electronic form of the ticket with a 2D barcode without security features (hereinafter referred to as "ticket@home") delivered to the ticket holder by email or made available for download from the website after entering the email address and password provided to the ticket holder after payment. The ticket@home is printed by the ticket holder at their own expense.

1.7.3 ticket2mobile with a 2D barcode stored in a mobile phone (hereinafter referred to as "ticket2mobile") is an electronic ticket stored in the ticket holder’s mobile phone or tablet.

1.7.4 Handling and archiving fee is a fee paid by the ticket holder to MaxiTicket for services related to handling, archiving, possible searching, recovery, and sending of the ticket via email, mail, or other delivery methods. The ticket serves as proof of payment. A separate confirmation is charged at €15.

The availability of individual types of tickets depends on the specific event and the capabilities of the Organizer.

2 Introductory Provisions

2.1 MaxiTicket, based on the Ticket Sales Cooperation Agreement concluded with the Organizer, ensures as an intermediary the sale of tickets to events in favor of the Organizer, and at the same time, on behalf of the Organizer, accepts from buyers the funds corresponding to the ticket purchase price. By paying the ticket price via the website https://www.maxiticket.sk the ticket holder enters into a legal relationship directly with the specific organizer of the selected event.

2.2 MaxiTicket is not responsible for the conduct, change, or cancellation of the event. The legal relationship between the event organizer and the ticket holder is governed by the valid terms and conditions of the specific event, or the organizer’s instructions.

2.3 Responsibility for publishing information about a change or cancellation of the event lies with the organizer, who shall publish this fact on their website.

3 Payment for Tickets

3.1 The ticket purchase price is final (including VAT if the Organizer is a VAT payer) and includes all applicable related fees. If the ticket delivery method by post or courier is selected, the customer is also obliged to pay postage and packing according to the specified rate. The customer is informed of the postage and packing amount before confirming the order, and this amount is added to the ticket purchase price.

3.2 Unless otherwise stated, a ticket processing fee is added to the ticket price.

3.3 In the case of online purchase, the final price of the selected tickets can be paid by payment card through the Cardpay service (virtual POS terminal of Tatra banka). Payment can be made using VISA or EUROCARD/MASTERCARD cards issued by any banking institution.

3.4 In the case of in-store purchase, it is possible to pay in cash or by VISA and EUROCARD/MASTERCARD cards.

3.5 Corporate clients may pay by bank transfer based on an invoice.

3.6 MaxiTicket provides ticket sales on behalf of and for the account of the event organizer. By purchasing a ticket, you enter into a legal relationship – a contract for the execution of the event – directly with the specific organizer of the selected event. According to Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods at a Distance or Outside Business Premises, as amended: "The consumer may not withdraw from a contract whose subject is the provision of accommodation services for purposes other than accommodation, the transport of goods, car rental, provision of catering services or leisure-related services, if the seller undertakes to provide such services at a specified time or within a specified period."

MaxiTicket is not authorized to accept a refund of the amount already paid for the ticket, not even in the event of a request to return the amount paid for an unused ticket.

3.7 In the case of cancellation of the Event, the Ticket Holder will be informed via the website https://www.maxiticket.sk about the process of refunding the ticket price as well as the places and contacts through which the refund will take place. In the event of Event cancellation, the Ticket Holder is not entitled to a refund of postage or other delivery charges or payment processing fees. If the Event information on https://www.maxiticket.sk states the processing fee amount (also printed on the Event Ticket), the Ticket Holder is not entitled to a refund of this amount in the case of cancellation.

4 Method of Ticket Delivery and Delivery Terms for Online Sales

4.1 In the shopping cart, the following ticket delivery methods can be selected:

4.1.1 by registered mail, where the postage fee will be charged in full to the ticket holder. The current postage amount is always listed as a processing fee. Tickets will be sent by the organizer within 2 business days from payment to the address provided at the time of ticket purchase.

4.1.2 online delivery to the ticket holder’s email as ticket@home or ticket2mobile. Tickets are considered delivered at the moment they are sent to the email address provided by the ticket holder. The current fee amount, if required by the organizer, is always listed as a processing fee. Tickets will be sent to the ticket holder within 24 hours of payment to the email address provided at the time of ticket purchase.

4.1.3 In the case of season tickets, the buyer exchanges the voucher obtained during the online sale for the season ticket at the organizer’s box office.

4.2 MaxiTicket and the organizer are not responsible:

4.2.1 for delayed delivery of ordered tickets caused by the postal or express courier service,

4.2.2 for delayed delivery of ordered tickets caused by the ticket holder failing to respect postal delivery terms,

4.2.3 for non-delivery of ordered tickets caused by incomplete, outdated, or otherwise incorrect postal address entered by the ticket holder,

4.2.4 for damage or loss of the shipment caused by the postal or express courier service.

5 Rights and Obligations of the Ticket Holder

5.1 The ticket holder is entitled to use the ticket for one-time entry to the event for which it was purchased (except for season tickets, i.e. tickets for events lasting one or more days – such as music festivals etc.). After leaving the venue, the ticket (except for season tickets) becomes invalid unless the organizer explicitly states otherwise for a specific event.

5.2 By purchasing the ticket, the ticket holder enters into a contractual relationship with the organizer of the event. By presenting the ticket at the entrance to the event, the ticket holder agrees to the organizer’s instructions at the event location and the conditions associated with them.

5.3 The ticket holder is obliged to check the ticket, ticket@home or ticket2mobile and the data on it immediately after delivery or receipt. Any errors may be promptly disputed by the ticket holder according to section 6 of these Terms and Conditions.

5.4. Archiving and Handling Fee: MaxiTicket is entitled to require the Customer to pay an archiving and handling fee for providing the ticket archiving service for each archived Ticket, and the Customer is obliged to pay it. The archiving and handling fee is generally charged together with the Purchase Price when purchasing the Ticket. The amount of the archiving and handling fee is displayed to the Customer during the Order creation process.

6 Complaints Procedure

6.1 If the purchased ticket contains defects (i.e., incorrect or missing information, issued for an event different from that ordered by the ticket holder, etc.), the ticket holder must file a complaint with MaxiTicket or the organizer without undue delay after receiving the ticket. Complaints can be made by sending an email to support@maxiticket.sk, by sending a written complaint via mail to the organizer’s address, or in person at the organizer’s point of sale where the ticket was purchased.

7. Liability

7.1 MaxiTicket and the organizer bear no responsibility for the loss, theft, damage or destruction of the ticket, and are not obliged to provide replacement tickets to the ticket holders.

8. Personal Data Protection

8.1 MaxiTicket as the operator of the website https://www.maxiticket.sk and the MaxiTicket system processes personal data of natural persons - users of the website/event applicants and/or ticket holders (hereinafter referred to as “data subjects”) as a controller in the sense of Article 4 para. 7 of the GDPR Regulation.

8.2 In order for the event applicant to use the services of MaxiTicket, i.e. to make a reservation and/or purchase a Ticket for the Event through the MaxiTicket system on the website www.maxiticket.sk, including related actions (ticket delivery, complaint handling, refunding the ticket fee, etc.), they must provide their personal data to MaxiTicket to the extent required by the selected/requested services. Without providing this personal data, MaxiTicket cannot offer the services of the MaxiTicket system to the event applicant and/or the ticket holder (e.g. without providing an email address, it is not possible to send ticket@home or ticket2mobile tickets, without providing an account number, it is not possible to refund the ticket price for a cancelled Event to the ticket holder, etc.). The purpose of processing the personal data of data subjects is therefore the operation of the MaxiTicket system and the use of its services. Accordingly, the event applicant will be prompted, before submitting the order, to confirm by ticking a checkbox that they have read, understood, and fully agreed with these GTC.

8.3 For this purpose, MaxiTicket processes the personal data of data subjects to the following extent: email address, first and last name, delivery address / billing address, phone number, order information (event name, ticket price, reservation number, payment date, variable symbol, ticket type, seat location), information about season tickets (if purchased), account number, payment details (in case the event was cancelled and ticket fees refunded through MaxiTicket), online identifiers (cookies, FB pixel codes, Google Adwords codes), and in specific cases (mainly large sports events), biometric facial scans when passing through the turnstile.

8.4 MaxiTicket processes personal data of data subjects on the basis of its legitimate interest pursuant to Article 6 para. 1 letter f) of the GDPR Regulation. The legitimate interest of MaxiTicket is to increase the use of the MaxiTicket system, i.e. to support mediated ticket sales for Events to users of the website www.maxiticket.sk . The legitimate interest of MaxiTicket also includes conducting direct marketing. For this purpose, MaxiTicket processes the data subject’s email address. MaxiTicket stores the processed personal data for the duration of the legitimate interest, i.e. until the interests or fundamental rights and freedoms of the data subject override such interests. For example, while the data subject is an active user of the MaxiTicket system (site www.maxiticket.sk). The legal obligation to retain data for the period specified by special regulations is not affected. To carry out certain tasks and/or operations that MaxiTicket cannot ensure with its own staff, it uses the services of other entities. For these purposes, personal data are made available to postal services, delivery companies, marketing agencies, platform providers such as Facebook, Google Analytics.

9. Final Provisions

9.1 MaxiTicket is entitled to unilaterally amend or supplement the provisions of the GTC for the purpose of adding missing conditions or due to changes in the legislation of the Slovak Republic. The amended GTC become effective on the day the new full version of the GTC is published at the web address https://www.maxiticket.sk.

9.2 The visitor and/or user, by confirming interest in purchasing a ticket for a selected event in the MaxiTicket system, agrees with the wording of these GTC, with which they were fully acquainted and accepted when completing the ticket purchase.

9.3 All relations not regulated by these GTC are governed by generally binding legal regulations valid in the territory of the Slovak Republic.
